Terms of Service

These Terms of Service ("Terms") govern your access to and use of the E-Labs AI platform (www.elabsai.com, copilot.elabsai.com, machine.elabsai.com, and related services) operated by E-Labs AI ("E-Labs", "we", "us", or "our"). By using our services, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using any E-Labs service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our services.
2. Account Registration
You must provide accurate, current, and complete information when creating an account. You are responsible for maintaining the security of your credentials. You must notify us immediately of any unauthorized access to your account.
3. Subscriptions and Billing
- Paid subscriptions are billed monthly through Stripe. Prices are listed on the Pricing page.
- Subscriptions auto-renew unless cancelled before the renewal date.
- To cancel, use the account management page or contact support at [email protected].
- Refunds are handled case-by-case. Contact support within 7 days of a charge to request a refund review.
- Enterprise and GPU Rental plans are custom-quoted and governed by a separate service agreement.
4. Acceptable Use
You agree not to:
- Use the platform for illegal activities or to generate harmful, hateful, or deceptive content.
- Attempt to reverse-engineer, exploit, or circumvent platform security controls.
- Use automated scripts to abuse or exceed usage limits beyond your subscribed tier.
- Share your account credentials with others outside your subscribed team plan.
- Use the platform to generate spam, malware, or phishing content.
5. Intellectual Property
E-Labs retains all rights to the platform software, branding, and UI. Content you generate using the platform (outputs, workflows, files) belongs to you, subject to the terms of any third-party AI model licenses used to generate them.
6. On-Premise Deployments
If you deploy E-Labs software on your own hardware, you are responsible for maintaining the security and compliance of that deployment. E-Labs is not liable for data breaches or losses arising from misconfigured on-premise deployments.
7. Service Availability
We aim for high availability but do not guarantee uninterrupted access. We may perform scheduled or emergency maintenance with reasonable notice. Enterprise SLA terms are governed by your custom service agreement.
8. Limitation of Liability
To the maximum extent permitted by law, E-Labs shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, revenue, or profits, arising from your use of the platform. Our total liability to you shall not exceed the amount you paid in the 12 months preceding the claim.
9. Termination
We may suspend or terminate your account for material violations of these Terms, with or without notice. You may cancel your account at any time. Upon termination, your access to the platform ceases and paid subscriptions are cancelled at the end of the current billing period unless otherwise agreed.
10. Changes to These Terms
We may update these Terms at any time. We will provide at least 14 days' notice of material changes via email or in-app notification. Continued use after the effective date constitutes acceptance of the updated Terms.
11. Governing Law
These Terms are governed by the laws of the State of Michigan, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Kent County, Michigan.
